Discrimination on the check-baby

When the government announced the measure last year, in Babies and more we have provided all the information related to the provision, from how and who can access it to our opinion about the aid, which like all help is welcome but we do not believe that Be the right way to promote birth.

There are 2,500 that the baby's family receives by birth or adoption of a child and here is the problem, which in practice not all families can receive the benefit.

In fact, the sectors that report that there is discrimination when it comes to providing benefits do not call it a baby check but rather "check-mom" because she is only the recipient of the aid, except in the case of gay marriages.

A mixed family formed by a Spanish father and a Peruvian mother has been surprised that they could not access the benefit, they have found it unfair and have started a crusade through the blog www.chequebebediscriminación.com where they invite other parents to join the complaint defending that the law should be declared unconstitutional for not respecting the right to equality.

In the blog they explain the three cases of discrimination:

1) When the couple is composed of a Spanish father and a foreign mother who does not reach 2 years of legal residence in Spain, they CANNOT receive the help, when the mother is Spanish and the father is a foreigner, YES, even if he does not legally reside.

2) in the case of a mixed homosexual couple, that is to say composed of a Spaniard and a foreigner, you can choose who best meets the requirements to collect the benefit, discriminating against heterosexual couples who cannot choose who is most suitable for collect it

3) Finally, in the case of foreign families who have a baby in Spain with legal residence, when the woman turns 2 years of legal residence, YES can collect the help, regardless of the father's situation, while when The father is Spanish. They CANNOT charge it.

Of course, the measure that was announced with bombs and saucers at the start of the election campaign does not meet the expectations of ALL parents of children born as of July 3, 2007.

The conditions should be the same for everyone, but the legal gap leaves around 12,000 mixed families without help and more to come. Apparently, although the government recognizes the "difference" at the moment it is not for the work of rectifying.

It is paradoxical that it is precisely foreign women who have contributed to raising birth rates in Spain and are discriminated against in the application of the law, even if they are married to Spaniards.

Hopefully the claims come to fruition.
